Buyers Want to Terminate a Purchase Contract

What happens when your buyers have a conditional offer on a property and change their mind?


Let you clients know that their deposit is safe. The Residential Contract of Purchase and sale is very clear in Clause 7.2 that if conditions are not removed in writing, the entire deposit is returned to the buyer.


Also, let them know that the seller does have the option seek a civil remedy for breach of contract (Clause 7.6), and if they are concerned about any repercussions, they should talk to their lawyer.


You are not obligated to tell the listing agent anything (and probably should not) other than the buyers are not removing conditions. If they want more details, it would be best to let them know that your clients have not given you permission to disclose why.
